A federal judge appointed by former President Joe Biden has blocked the Department of Homeland Security from deporting illegal aliens to “third countries” without giving them notice and a chance to challenge the removal.
The third-country deportation policy allowed the Trump administration to send illegal aliens to countries that were not their country of origin in cases where the third nation agreed to accept the deportee, but their home country did not.
U.S. District Judge Brian Murphy has now blocked the policy, claiming that it violates due process protections. The Department of Homeland Security has continued to assert that they do indeed have the authority to do this and may appeal Murphy’s ruling to the 1st Circuit Court of Appeals.
Judge Murphy did stay his order for 15 days to give DHS time to appeal.
