The death sentence for Texas inmate Robert Roberson has been stayed just days before it was to be carried out on October 16th..

The ruling was sent down by the Court of Criminal Appeals on Thursday. This was the second time this year that Roberson has been spared.

Roberson was convicted of capital murder in 2003 for the death of his two-year-old daughter Nikki, who was diagnosed with shaken baby syndrome. He has maintained his innocence over more than 20 years on death row, with his attorneys arguing that the science behind Nikki’s shaken baby diagnosis no longer held up.

This is the second time that Roberson has been granted a stay of execution. The first time was last year.
