MS-13 gang member, El Salvadoran national, and illegal alien Kilmar Abrego Garcia is back on America's streets following Magistrate Judge Barbara D. Holmes' ruling that he doesn't have to remain in federal custody while he awaits his trial.

Garcia is facing a number of serious allegations, including solicitation of child pornography, trafficking of drugs, weapons, and people, and even participating in the murder of the mother of a rival gang member.

There have also been allegations that Garcia had sexual relationships with some of the females he trafficked, including minors. Garcia has also been accused of soliciting child pornography.

Garcia had previously turned down a plea deal, which would have required him to plead guilty to human trafficking but allow him to be deported to Costa Rica following his release from prison. He is now in the custody of his brother in Maryland and is required to wear a monitor.

Judge Holmes is now facing scrutiny for allowing Garcia to leave prison, with many pointing to her long history of donating to Democratic candidates, including a $250 donation to Hillary Clinton's 2008 presidential bid.

She's registered as an unaffiliated voter, however, and has voted in some Republican primaries while voting Democratic in other races.
