Paxton Lawsuit Against Austin For Decriminalizing Pot Possession Dismissed

Texas Attorney General Paxton's lawsuit against an Austin law decriminalizing pot possession is now tossed out by a Travis County state district judge. The lawsuit by Paxton's office also sought to strike down voter-approved laws in San Marcos, Killeen, Denton, and Elgin prohibiting police from arresting people for minor pot possession. The lawsuit claimed local ordinances can't override state laws. On Tuesday, Judge Jan Soifer dismissed the lawsuit with prejudice, meaning that it can't be refiled. Paxton is expected to appeal.
