The state's first cite and release city ordinance is now in effect. There are cite and release resolutions in effect in some cities such as Austin and San Antonio, but San Marcos is the first to enact an ordinance. It went into effect yesterday. Police are required to cite and release those they nab for minor offenses. The ordinance is obligatory unlike a resolution that provides for a police officer to be able to use his or her own judgment on a case-by-case basis.
