A Texas man is being taken off death row after a judges ruled he needed to re-sentenced. The Texas Court of Criminal Appeals vacated the sentence for Cesar Fierro today saying El Paso County jurors were given faulty instructions in 1980. Fierro was convicted of capital murder and given the death penalty for the 1979 shooting death of a taxi cab driver. It will be up to prosecutors to decide if they will seek the death penalty again or seek life in prison.
