Duncan Scammer Expected to Appeal Prison Sentence

It looks like San Antonio hasn't seen the last of Charles Banks, the admitted swindler who pled guilty to stealing millions from Tim Duncan.

Sources close to the case tell News Radio 1200 WOAI Banks attorney John Murphy says he 'will in all likelihood' appeal the four year federal prison sentence handed down to Banks last month following his guilty plea to wire fraud charges.

The sentence came following an emotional two day hearing, in which prosecutors read a statement from Duncan expressing embarrassment at being known as the pro athlete who was suckered by a scammer, and urging punishment for Duncan to make sure other scammers don't feel they have a free hand to prey on young athletes.

Banks, who was a prominent wine industry leader as well as the co founder of a hedge fund before pleading guilty in the Duncan case, had asked for probation.

He is set to report to begin his federal prison sentence next month.
