Police are investigating a man's claim that he shot and killed a man who was attempting to break into his van as it was parked in front of a north side restaurant, News Radio 1200 WOAI reports.
A man was in the driver's seat of the van in front of the Texas Land & Cattle Company Restuarant at Loop 410 and McCullough late Monday night.
Apparently a 30 year old man didn't know that the driver was in the van when he broke open the back door and climbed inside.
He also didn't know the driver was armed.
The man said he fired one shot, shooting the would-be burglar in the neck.
The man was rushed to the hospital, where he was pronounced dead.
Police say if the van owner's story checks out, he is unlikely to face any criminal charges.
