Second Suspect Charged in Rolling Oaks Murder

The second suspect in Sunday's shooting spree at Rolling Oaks Mall has now formally been charged with capital murder, News Radio 1200 WOAI reports.  

Police also charged Jose Luis Rojas, 34, with two counts of aggravated robbery.  Rojas remains in critical condition after he was shot by a bystander at the mall as he and Jason Prieto, also 34, were running out of the Kay Jewelers at the mall after sticking up the business.  

Prieto is also charged with capital murder and aggravated robbery.  Prieto is held on $1.7 million bond and is in the Bexar County Jail.

  Bond for Rojas is also set at $1.7 million, but he remains in the hospital in critical condition.  

Police aren't sure which of the men shot Jonathan Murphy, 42, a shopper at the mall, who was killed instantly when he attempted to stop the two men from making their getaway.

  Prieto also shot two civilians as he was running out of the mall.  He was later arrested after wrecking his stolen car on Loop 1604 in Converse.
