An Appeals Court is rejecting a challenge to Harvard using race in undergraduate admissions.
A group had challenged the affirmative action policies saying they discriminated against Asian Americans. Circuit Judge Sandra Lynch said the Ivy League school's consideration of race was not impermissibly extensive.
Instead, she ruled it is meaningful to Harvard's admissions process because it prevents diversity from plummeting.
President Trump had backed the challenge. The panel ruled 2-0 to reject the challenge. The third judge on the panel died last month.
