First Lawsuit Filed in New Braunfels FBC Bus Tragedy

The first of what is expected to be several high dollar lawsuits stemming from last month's bus crash in Uvalde County demands a million dollars from the driver of the pickup that hit the church bus and the driver's father, who the lawsuit claims owns the truck," News Radio 1200 WOAI reports.

13 members of New Braunfels First Baptist Church were killed March 28 when a pickup driven by Jack Young, 20, of Leakey, crossed the center line of Highway 83 in Uvalde County and slammed head on into the bus.

The lawsuit claims Young was negligent because he was smoking marijuana and taking prescription drugs, as well as texting, at the time of the wreck.  The father, Joseph Young, is named as a defendent because he allegedly allowed his son to drive his truck, knowing that he had a habit of driving while under the influence of drugs and while texting.

While it is widely believed that Young was texting while driving...a witness to the wreck told News Radio 1200 WOAI that Young admitted to him he had been texting while he was still pinned in the wreckage...no charges have been filed, and the National Transportation Safety Board is still investigating the extent to which both drug use and texting may have contributed to the accident.

Young has been released from the hospital.
