Bergdahl Sentencing Delayed on 'Unlawful Command Interference' Claim

The sentencing trial for confessed deserter Bowe Bergdahl, who is still stationed with Army North at Ft. Sam Houston, has been delayed until Wednesday, News Radio 1200 WOAI reports.

The delay was announced today at Ft. Bragg after defense attorney Eugene Fidell filed a motion asking that the entire case against Bergdahl be dismissed, due to comments made on the campaign trial in 2016 by then candidate Donald Trump.

Trump told audiences on several occasions that Bergdahl, who deserted his forward operating post in Afghanistan in 2009, is a 'no good traitor' who 'should be shot,' once even using his fingers to look like a gun.

Fidell argued in his motion that the comments were made by the man who is now the Commander in Chief, and they represent Unlawful Command Interference, which is specifically prohibited by the Uniform Code of Military Justice.

Since the military is a command organization, and members are legally obligated to follow the legal orders of their superiors, Unlawful Command Interference is meant to prevent superior officers, through their comments or actions, to imply that a certain defendant should be convicted or acquitted.
